My husband, a dedicated truck driver with 27 years of experience, has always maintained a clean driving record for many years. Despite his exemplary service and spotless recent history, he has recently faced an unexpected and severe setback due to traffic violations from the year 2000. These violations, although resolved and paid off decades ago, have resurfaced to disqualify him under the Federal Motor Carrier Safety Administration (FMCSA) regulations.
Understanding the Law: The FMCSA regulations, found in 49 CFR §383.51, specify disqualification periods for multiple serious traffic violations within a three-year period. This includes violations like excessive speeding, reckless driving, improper lane changes, following too closely, and violations connected to fatal accidents. Here’s the critical part:
- Second serious traffic violation within three years: 60-day disqualification
- Third or subsequent serious traffic violation within three years: 120-day disqualification

Our Situation: Without any prior warning, my husband was disqualified for 120 days due to three tickets from over 20 years ago, despite having a clean driving record for many years. This sudden disqualification led to him losing his job, disrupting our lives and leaving us in a state of crisis. We have tried seeking help from lawyers and trucking associations, but it seems there is no recourse or way to rectify this issue.
A Call for Awareness: This situation feels incredibly unfair and unjust, especially given my husband’s dedication and the sacrifices he has made throughout his career. We are now faced with the daunting challenge of starting over and dealing with the severe consequences of actions taken decades ago. This is a stark reminder that even past mistakes can have lasting impacts under current regulations.
I share this story to caution my fellow truck drivers and their families. It is crucial to understand the implications of FMCSA regulations and to be aware of how even old violations can suddenly and dramatically affect your livelihood.
